Frequently Asked Questions

What is the Western Express TCPA Settlement about?

The lawsuit alleges Western Express violated the Telephone Consumer Protection Act by sending unsolicited prerecorded calls to cell phones. Western Express denies wrongdoing but agreed to settle to avoid further litigation.

How much money will I receive from the Western Express TCPA Settlement?

Eligible class members may receive up to $120. The exact amount depends on how many approved claims are filed and required deductions for fees and costs.

When will payments from the Western Express TCPA Settlement be sent?

Checks will be mailed after the Court grants final approval and any appeals are resolved. This process can take several months—patience is encouraged.

Do I need proof of the prerecorded call?

Call records obtained in the case identify class members. If you received a postcard or your number appears in those records and you meet the class definition, you are eligible to file a claim.

Can I still sue Western Express if I accept this settlement?

No. By submitting a claim or staying in the class, you waive the right to bring your own lawsuit over the issues covered. To preserve that right, you must exclude yourself by the deadline.
