Settlement Benefits
Defendants Safeway/Albertsons, Advantage Solutions, and Costco agreed to create a $1,035,000 Gross Settlement Fund. After court-approved deductions, the Net Settlement Amount will be distributed to participating class members based on the number of “shifts” you worked:
- Individual Class Payments: pro-rated by shifts (10 % wages / 90 % interest & penalties for tax purposes).
- PAGA Payments: additional pro-rated amounts even if you opt out of the class portion.
Payments will be mailed automatically to known class members; others must file a timely claim with documentation.

Frequently Asked Questions
What is the Trevethan v. Best Reps, Inc. settlement about?
Plaintiff Donna Trevethan alleged Safeway, Albertsons, Costco, Advantage Solutions, and Integro failed to provide meal/rest breaks, pay all wages, and furnish accurate wage statements to demo workers. The case settled for $1.035 million without any admission of wrongdoing.
How is my payment calculated?
Your share equals the Net Settlement Amount divided by the total qualifying shifts and then multiplied by the number of shifts you worked. Separate pools exist for Safeway-related and Costco-related work.
Do I need to do anything to get paid?
If you received a mailed notice, no. Otherwise, you must submit the claim form with proof of demo shifts before March 3, 2026.
Can I object or opt out?
Yes. Send a written objection or opt-out request postmarked by March 3, 2026. Opting out waives your class payment but you will still receive the PAGA share.
When will checks be mailed?
If the Court grants final approval on April 14, 2026 and no appeals delay the process, expect checks a few months later. Appeals could extend the timeline by a year or more.
Where can I read the full settlement agreement?
A copy is on file with Alameda County Superior Court and can be viewed online at alameda.courts.ca.gov.
