  • Used a finger-scan time clock while employed,
  • Between September 1 2012 and November 1 2017.

Expected Payment Amount

The parties estimate each qualifying employee will receive about $970. The exact figure may rise or fall depending on:

  • Final court-approved deductions for attorneys’ fees, expenses and service award
  • The confirmed number of eligible class members
  • Whether any settlement checks go uncashed (uncashed funds of $74,000+ trigger a second distribution)

How and When You’ll Be Paid

No action needed. Checks will be mailed to the last known address of each class member roughly 45 days after the settlement receives final court approval and any appeals are resolved.

Why the Lawsuit Was Filed

The plaintiff alleged Speedway violated the Illinois Biometric Information Privacy Act (BIPA) by collecting workers’ fingerprint data for timekeeping without first providing a written disclosure and obtaining written consent. Speedway denies any wrongdoing but agreed to settle to avoid further litigation risk.
