What is the Smith et al. v. Memorial Hospital & Manor settlement about?
The class action alleges MHM failed to safeguard patient data compromised during the November 2024 cyberattack. The settlement provides monitoring and cash compensation without admitting liability.
Do I have to pay a lawyer to participate?
No. The Court-appointed class counsel will request fees (up to $500,000) to be paid separately by MHM, not from your benefits.
Can I seek more money later if I join?
No. By submitting a claim or doing nothing, you release your individual claims relating to the breach. Opting out preserves your right to sue MHM separately.
How will I receive my payment?
After final approval and any appeals, payments will be issued by check or electronic transfer, depending on your claim-form selection.
