You are a class member if both statements are true:
- You were a natural gas customer of the City of Pensacola, Pensacola Energy, or Energy Services of Pensacola anytime from Aug. 6, 2011 to present.
- Your natural-gas service address was located inside the Pensacola city limits.
Two Customer Groups
- Current customers – No claim form needed. The settlement administrator will mail a check to the address on file.
- Former customers – Must submit a claim online or by mail to receive payment.
Potential Cash Payments
The $12.6 million fund will be divided pro rata based on the franchise fees each class member was charged since Aug. 6, 2011.
Individual award = Net Settlement Fund × (Your franchise fees ÷ Total franchise fees for all class members)

Key Dates

Why the Lawsuit Settled
Plaintiffs alleged Pensacola unlawfully passed franchise fees and related utility taxes on to customers, arguing the charges were unauthorized under the Florida Constitution.
