Who Is Eligible?
- New Mexico residents who paid for stacked UM/UIM coverage while insuring only one vehicle (auto, motorcycle, or RV).
- Policy issued, renewed, or in force with any Progressive-branded company between 1/1/2009 – 4/30/2025.
- Exclusions: Progressive employees, judges on the case, anyone who sues separately, or those who opt out.

- $10 + payments mailed automatically unless you select PayPal/Venmo/EpiqPay.

- Refund pool: $37,000 – $75,000 (pro-rata; capped at 100% of overcharge).

How to Get Your Money
- Locate the notice you received by mail or email (sent November 28 2025).
- Visit the official settlement portal and enter your Notice ID to:
- Confirm or update your mailing address.
- Choose PayPal, Venmo, EpiqPay, or check.
- (If in the earlier period) Upload the completed claim form below.
- Wait for payment — most checks or e-payments issue within 45 days of final approval.

- What is the Peck v. Progressive Settlement about?
- The lawsuit claims Progressive charged extra for stacked UM/UIM coverage on single-vehicle policies without providing any real benefit, violating New Mexico law. Progressive denies wrongdoing but agreed to refund class members.
- Do I need to hire a lawyer to participate?
- No. Class Counsel already represents you at no cost. Attorneys’ fees (up to $977,609.04) are paid separately by Progressive and will not reduce your refund.
- Will filing a claim raise my insurance premiums?
- No. The settlement expressly states that receiving a payment or filing a claim will not affect your premiums.
- How much will I receive from the Peck v. Progressive class action?
- If you’re in the automatic group, you get the full premium difference. Claim-based members receive a pro-rata share of $37k-$75k, up to 100 % of the overcharge.
- What happens to unclaimed funds?
- Any leftover money will be donated to the New Mexico non-profit Equal Access to Justice, Inc., subject to court approval.
