Were you a Young America or Loya Insurance policyholder in New Mexico between October 1, 2010 and February 28, 2022? You could automatically receive a partial refund of UM/UIM premiums, or—if you filed a UIM claim that was reduced due to an “offset”—you may submit a claim for a readjustment and additional payment. Who Is Eligible?
- Premium Refund Class – All New Mexico residents who paid for UM/UIM coverage with Young America Insurance Company (YAIC) or Loya Insurance Company (LIC) at any point from 10/1/2010-2/28/2022.
- UIM Readjustment Class – Anyone who:
- Made a UIM claim after 10/1/2010 under a YAIC or LIC policy issued between the above dates;
- Had the claim reduced or denied because the insurer “offset” the other driver’s liability limits; and
- Did not receive the policy disclosure/exclusion later required by the New Mexico Supreme Court in Crutcher v. Liberty Mutual (2021).
Settlement Benefits
1. Automatic Refunds of UM/UIM Premiums
- No claim form needed.
- Checks mailed automatically to the last known address after the settlement is finally approved.
- Amount based on the premiums you paid and money remaining in the $1.95 million Settlement Fund.
2. UIM Claim Readjustment (up to $800,000 total)
- Submit a Claim Form by March 12, 2026 for re-evaluation of your bodily-injury or property-damage UIM claim.
- Provide any supplemental documents the insurer requests.
- If you disagree with Loya’s determination, you can appeal to a neutral referee for a $50 fee (refunded if you win).
