Who Is Eligible?

  • Current or former NYCB checking-account holders who:
  • Paid an NSF or overdraft “Retry Fee” on ACH or check items re-submitted between March 2 2017 – January 1 2020, and/or
  • Paid a second out-of-network ATM fee on withdrawals preceded by a balance inquiry between August 20 2020 – February 20 2024.

Settlement Benefits

  • Total fund: $1,233,500.
  • After court-approved deductions (attorneys’ fees, costs, service awards & administration), the net fund will be split pro-rata among eligible customers.
  • Current accountholders will receive an automatic credit; former accountholders will be mailed a check.

  • Do nothing – keep your rights to payment and release claims.
