Kansas City Life Insurance $40M Class Action Settlement

If you owned — or previously owned — a Kansas City Life Insurance Co. flexible premium adjustable life policy that was in force on or after Jan. 1, 2002, you could automatically receive a cash payment from a $40 million class action settlement. Who qualifies for the Kansas City Life settlement?

The settlement class covers approximately 88,000 Kansas City Life Insurance Co. (KCL) policyholders and estates that owned one of the following flexible premium adjustable life products active on or after Jan. 1, 2002:

  • Better Life Plan (standard & Qualified)
  • LifeTrack, AGP, MGP, PGP, Chapter One, Classic, Century II (except Missouri issues)
  • Rightrack (89), Performer (88 & 91), Prime Performer
  • Competitor (88 & 91), Executive (88 & 91), Executive II, Competitor II
  • Protector 50, LewerMax, Ultra 20 (93 & 96), Performer II

Settlement benefits

Every eligible class member will receive a cash payment based on the total cost-of-insurance (COI) charges taken from their policy, divided pro rata across the net $40 million fund after:

  • Up to $13.33 million in attorneys’ fees
  • Up to $1.175 million in litigation expenses
  • Service awards up to $25,000 each for four lead plaintiffs
  • Administrative costs for notice and distribution

How and when will I get paid?

  • No claim form required. Checks will be mailed automatically to the address on file with KCL.
  • Payout timing: About 60 days after the court grants final approval.

Why is there a settlement?

Plaintiffs alleged that KCL deducted COI charges in ways that violated policy terms, including:

  • Using non-mortality factors not authorized by the contract
  • Failing to reduce COI rates when mortality expectations improved
  • Embedding expense loads in COI rates instead of listing them separately

KCL denies wrongdoing but agreed to settle to avoid further litigation risk.

How is my payment calculated?

Your share equals the COI charges paid on your policy divided by the total COI charges paid by all class members, multiplied by the net settlement fund.
