If you delivered Lowe’s merchandise in Massachusetts for RXO between July 20 2015 and August 12 2025, you may be owed money from a $2.25 million class action settlement. Submit your claim by December 8 2025 to secure your share.

Who Is Eligible?

The settlement covers:

  • All drivers who performed deliveries in Massachusetts on behalf of RXO (formerly XPO) to Lowe’s customers from 7/20/2015 – 8/12/2025.
  • Helpers and drivers who signed contracts directly with RXO are excluded.

What the Lawsuit Alleged

Three former drivers claimed RXO misclassified them as independent contractors, resulting in:

  • Unlawful pay deductions tied to customer complaints.
  • No access to employee benefits such as vacation pay and earned sick time.

RXO denies any wrongdoing, but both sides agreed to settle to avoid the uncertainty of trial.

Settlement Benefits

  • Total fund: $2,250,000.
  • Attorney fees: up to one-third of the fund (subject to Court approval).
  • Service awards: up to $25,000 for each of the three class representatives, and $2,500 each for seven deponents.
  • The remaining net amount will be distributed pro-rata based on each driver’s estimated number of Lowe’s deliveries.

Your Options & Deadlines

  • Submit a Claim — 12/8/2025: Complete and return the claim form to Simpluris (mail, fax, email, or online with your Unique ID/PIN).
  • Opt Out — 12/8/2025: Send a written opt-out request to Class Counsel if you do not want to be bound or paid.
  • Object — 12/8/2025: File a written objection with the Court if you disagree with the settlement terms.
  • Fairness Hearing — 1/27/2026 at 2:30 p.m. (via Zoom): The Court will decide whether to grant final approval.

Important: You must file a claim to receive money. If you do nothing, you give up the right to sue RXO over these claims and will not receive a payment.
