Who’s eligible?

  • You had a consumer (personal) account at Drummond Community Bank, not a business account.
  • Between Nov. 24, 2018 – Feb. 11, 2023 the bank assessed at least one of the challenged fees:
    • $36 overdraft fee on a one-time, non-PIN debit card purchase that was authorized with a positive balance but posted with a negative balance (APSN fee).
    • $36 “retry” fee on the second or third presentment of the same declined check or ACH transaction.
  • You received a postcard or email notice confirming the bank’s records show such a fee.

What benefits can I receive?

  • Automatic cash payment / account credit from the net settlement fund, calculated pro-rata based on how much in challenged fees you paid versus all class members.
  • Debt forgiveness and charge-off of any negative balance on closed consumer accounts that incurred a challenged fee during the class period.

How will payments be calculated?

The settlement administrator will use bank records to apply this formula:

(Your total challenged fees ÷ All class members’ challenged fees) × Net settlement fund

The amount you receive will not exceed what you actually paid and will be reduced by court-approved attorneys’ fees, costs, and service awards.

Do I need to do anything?

  • No claim form is required. Funds will be sent automatically after final approval.
