Who is eligible?
The settlement class covers anyone whose private information was potentially compromised in the Capital Health data incident between November 11 and November 26, 2023. This includes patients, former patients, guarantors, and employees whose data—such as names, Social Security numbers, addresses, dates of birth, emails, phone numbers, or clinical details—may have been accessed.
Available benefits
- Cash Payment A – Documented Losses: Reimbursement up to $5,000 for out-of-pocket expenses linked to the breach (e.g., identity-theft losses, credit-monitoring costs, postage, mileage).
- Cash Payment B – Alternative Cash: Estimated $100 flat payment if you prefer not to (or cannot) provide documentation.
- Credit Monitoring: Three years of complimentary credit-monitoring services (valued at $270 total).
All cash payments may be increased or reduced pro rata depending on the number of valid claims.

Court & attorneys’ fees
The U.S. District Court for the District of New Jersey will decide whether to grant final approval. Class Counsel intend to request attorneys’ fees up to one-third of the $4.5 million fund and service awards up to $4,000 each for class representatives. These amounts will not reduce your individual benefit unless the Court orders otherwise.
