  • You were a member, participant, or beneficiary of an ERISA-governed employee welfare benefit plan administered or insured by Aetna Life Insurance Co.
  • You (or a covered beneficiary) were diagnosed with localized prostate cancer and had an intact prostate.
  • A precertification request for proton beam therapy was denied between Jan. 1 2015 and Mar. 31 2024 because the treatment was labeled “experimental,” “investigational,” “unproven,” or similar language not in the plan’s definition of medical necessity.
  • You ultimately received PBT for the same diagnosis code and did not have allowed claims for another recognized treatment.

Those whose post-service PBT claims were later denied under the same criteria are also included. Individuals who obtained PBT coverage from another insurer or received a denial for administrative reasons are excluded.

Potential Payout

  • Minimum payment: $12,000 per valid claim.
  • Maximum payment: Up to $48,000 with proof of PBT expenses or debt above $12,000.

The settlement sets aside $3,408,000 for an estimated 71 class members. If fewer claims are filed, unclaimed funds may be donated to court-approved charities or revert to Aetna.
